Special Education Due Process Hearings: What You Need to Know Before You File

Description:
A due process hearing before an Impartial Hearing Officer is one option to address conflicts that may arise between parents and school districts in special education. Because it is a formal, legally binding, and time-consuming process, it is essential to understand when and why a due process hearing is the right option. Participants will gain a practical understanding of due process from a panel that includes an experienced special education Impartial Hearing Officer, student/parent attorney, and a school attorney.
Learning Objectives:
1. What is a due process hearing
2. What types of disputes can due process hearings resolve
3. What types of remedies are available through due process hearings
4. Important considerations when deciding to use a due process hearing
5. An overview of due process procedures and requirements, including the resolution process
6. Whether parents should consider legal representation
7. Brief overview of alternatives to due process hearings to resolve special education disputes
