Hindi ko alam kung ito ay ginagamit din ng ibang units, pero nagustuhan ko ang simpleng mensahe nito.

Sa pagkakaintindi ko, ganito ang ibig sabihin nito:

𝐑𝐞𝐦𝐢𝐧𝐝𝐞𝐫𝐬 – Hindi sapat na minsan lang sabihin ang tama. Ang disiplina ay hindi isang lecture na minsan lang ginagawa; ito ay paulit-ulit na 𝐩𝐚𝐠𝐩𝐚𝐩𝐚𝐚𝐥𝐚𝐥𝐚 ng ating tungkulin, layunin, at tamang asal bilang pulis. Di dapat mapagod ang supervisors and commanders na magremind. (PICE, Office meetings, Commander's Time, Viber Group, Chat Group Reminders, etc)

𝐎𝐛𝐞𝐝𝐢𝐞𝐧𝐜𝐞 – Ang mga lawful orders na naaayon sa ating tungkulin, o layunin ay dapat sundin. Mahirap magkaroon ng organisasyong may disiplina kung may myembro na hindi marunong sumunod sa bagay-bagay na palaging nireremind.

𝐀𝐜𝐜𝐨𝐮𝐧𝐭𝐚𝐛𝐢𝐥𝐢𝐭𝐲 – Dapat may pananagutan ang bawat kilos at desisyon. Kapag may pagkakamali, o disobedience sa mga reminders, —inaako ito at itinutuwid. Dinidisplina ang personnel o kaya ay kinakasuhan.

𝐃𝐞𝐝𝐢𝐜𝐚𝐭𝐢𝐨𝐧 – Ang serbisyo sa bayan ay hindi lang trabaho. Ito ay panata na nangangailangan ng sipag, malasakit, at katapatan araw-araw.

Nagustuhan ko ang prinsipyong ito, lalo na ang 𝐑𝐞𝐦𝐢𝐧𝐝𝐞𝐫𝐬.

Kadalasan, hindi naman dahil hindi alam ng isang pulis ang tama kaya siya nagkakamali. Minsan, dahil sa pagod, tukso, o pagiging kampante, nakakalimutan lang niya ang mga prinsipyong dati niyang pinanghawakan.

Kumbaga, ang gamot sa nakakalimot ay paalala.

Kaya kung may maliit man akong maiaambag, ito iyon.

Sa pamamagitan ng page na ito, patuloy akong magbibigay ng mga paalala—hindi para manghusga, kundi para 𝐢𝐩𝐚𝐚𝐥𝐚𝐥𝐚 kung bakit natin isinuot ang uniporme.

Thank you for sharing your loved one with the nation.

We know it isn't easy.

You celebrate birthdays without them.

You eat meals with an empty chair.

You postpone family plans because duty suddenly calls.

Sometimes, they leave before sunrise...

and return long after everyone is asleep.

Sometimes they miss Christmas.

Anniversaries. Graduations.

Even the ordinary evenings that families treasure.

It hurts.

And that hurt is real.

But please remember...

When your husband or wife doesn't answer the phone immediately,
it may not mean they don't want to.

They may be responding to someone else's emergency.

Behind every police officer who remains strong in the streets...
is often a family that remained strong at home.

Your patience becomes their strength.

Your encouragement becomes the reason they keep going after difficult days.

So when they finally come home...
welcome them with peace instead of another battle.

Listen before judging.

Embrace before complaining.

Ask how they are.

Sometimes, the strongest person in uniform is carrying burdens they cannot describe.

One kind word from home can heal what the world has wounded.

CASE REVIEW 19: “Illegal arrest is not merely a procedural mistake—it can be Grave Misconduct.”

PO3 Jerry Ines v. Muhad M. Pangandaman
G.R. No. 224345, September 2, 2020

FACTS:

Si Muhad M. Pangandaman ay inaresto ng ilang police officers habang siya ya nagbabantay ng kanyang store dahil umano sa paglabag sa gun ban. Dinala siya sa Police Station 6, Batasan Hills, Quezon City, kung saan siya ay dine-tain.

Ayon sa reklamo, humingi ang mga police officers ng ₱200,000.00 kapalit ng kanyang release. Nang hindi siya agad pinakawalan kahit na naibigay na ang unang halaga, muling humingi ang mga pulis ng karagdagang ₱100,000.00, at saka lamang siya pinakawalan. Kabilang sa mga police officers na nakilalang lumahok sa pag-aresto kay Pangandaman si PO3 Jerry Ines.

Dahil dito, nagsampa si Pangandaman ng administrative complaint for Grave Misconduct laban sa mga police officers na sangkot sa insidente.

Itinanggi ni Ines ang kanyang liability. Iginiit niya, bukod sa iba pa, na walang direct evidence na siya mismo ang nanghingi o tumanggap ng pera mula kay Pangandaman. Itinuro rin niya na hindi siya tahasang pinangalanan sa original na Sinumpaang Salaysay ni Pangandaman at saka lamang siya partikular na nabanggit sa sumunod na Karagdagang Sinumpaang Salaysay.

Gayunman, found guilty of Grave Misconduct si Ines ng Ombudsman at siya ay dismissed from the service. Inaffirm naman ng Court of Appeals ang ruling ng Ombudsman.

Dahil dito, umabot ang kaso sa Supreme Court.

ISSUE: Whether ang participation ni PO3 Jerry Ines sa illegal arrest kay Pangandaman ay nag-constitute ng Grave Misconduct na sapat upang siya ay ma-dismiss sa PNP.

RULING: YES.

Idineklara ng Supreme Court na guilty si PO3 Jerry Ines of Grave Misconduct.

Binigyang-diin ng Court na napatunayan ng evidence na si Ines ay kabilang sa mga police officers na lumahok at nagsagawa ng illegal arrest kay Pangandaman.

Ayon sa Supreme Court, ang participation ng isang police officer sa isang illegal arrest ay maaaring maging Grave Misconduct kapag ang illegal arrest ay nagpapakita ng clear intent to violate the law at ito ay directly connected sa kanyang official duties bilang police officer.

Mahalagang i-distinguish ang Grave Misconduct sa isang simpleng error of judgment. Para maging grave ang misconduct, kinakailangang makita ang corruption, clear intent to violate the law, o flagrant disregard of an established rule.

Sa kasong ito, ang illegal arrest ay hindi lamang isang personal na pagkakamali o isolated act ni Ines. Ginamit niya ang authority at position niya bilang police officer upang maisagawa ang illegal arrest. Dahil dito, ang kanyang misconduct ay may direct connection sa kanyang official functions.

Sa madaling salita, ang ginawa ni Ines ay hindi simpleng mistake lamang sa pagganap ng kanyang tungkulin. Ang kanyang unlawful exercise of police authority ay isang seryosong paglabag sa batas at sa kanyang tungkulin bilang police officer, kaya ito ay nag-constitute ng Grave Misconduct.

𝐂𝐀𝐒𝐄 𝐑𝐄𝐕𝐈𝐄𝐖 𝟐𝟎: 𝐊𝐀𝐒𝐀𝐌𝐀 𝐊𝐀 𝐒𝐀 𝐏𝐑𝐎𝐂𝐄𝐒𝐒, 𝐋𝐈𝐀𝐁𝐋𝐄 𝐊𝐀 𝐃𝐈𝐍 𝐁𝐀 𝐒𝐀 𝐊𝐀𝐒𝐎 𝐊𝐔𝐍𝐆 𝐌𝐀𝐘 𝐈𝐑𝐑𝐄𝐆𝐔𝐋𝐀𝐑𝐈𝐓𝐘?

𝐒𝐏𝐎𝟒 𝐏𝐚𝐝𝐨𝐣𝐢𝐧𝐨𝐠 𝐯. 𝐅𝐢𝐞𝐥𝐝 𝐈𝐧𝐯𝐞𝐬𝐭𝐢𝐠𝐚𝐭𝐢𝐨𝐧 𝐎𝐟𝐟𝐢𝐜𝐞-𝐎𝐦𝐛𝐮𝐝𝐬𝐦𝐚𝐧
G.R. No. 233892, October 13, 2021

𝐅𝐀𝐂𝐓𝐒: The PNP procured three Light Police Operational Helicopters (LPOHs) from Manila Aerospace Products Trading (MAPTRA) for ₱104,985,000.00. The helicopters were represented as brand new, but later investigation revealed that two were actually secondhand units previously owned by former First Gentleman Jose Miguel Arroyo.

Si SPO4 Ma. Linda Padojinog ay member ng Technical Working Group at Inspection and Acceptance Committee (IAC).

During the inspection, pumirma siya sa report na naglalaman ng actual observations niya, kasama na ang ilang discrepancies sa prescribed specifications.

Pero despite these discrepancies, nag-issue ang IAC ng resolution na nagsasabing compliant ang helicopters at tinanggap ang mga ito for PNP use.

Nang lumabas ang controversy, sinampahan ng administrative charges si Padojinog. The Ombudsman found her guilty of Serious DISHONESTY and Conduct Prejudicial to the Best Interest of the Service and dismissed her from the service. Inaffirm naman ito ng Court of Appeals.

𝐈𝐒𝐒𝐔𝐄: Puwede bang managot si Padojinog dahil lang sumali siya sa procurement process at pumirma sa inspection report na konektado sa isang irregular transaction?

𝐑𝐔𝐋𝐈𝐍𝐆: HINDI.

Hindi automatic na liable ang isang personnel dahil lamang involved siya sa isang procurement na nagkaroon ng irregularity.

Ang role ni Padojinog ay limited sa pag-inspect ng helicopters based on the prescribed specifications. Wala rin siyang authority na mag-approve o gumawa ng final recommendation para sa acceptance ng helicopters.

More importantly, hindi niya itinago ang mga nakita niyang problema. Sa halip, isinulat niya mismo sa report ang actual observations niya, kasama ang mga discrepancies.

Kaya ang report na kanyang pinirmahan ay naging evidence of the irregularities, hindi evidence ng kanyang dishonesty.

The Court emphasized that dishonesty is not simply negligence or poor judgment.

Kailangan may intention na magtago ng katotohanan, magsinungaling, manlinlang, o mandaya.

Ang ginawa ng Ombudsman ay mag-infer na dahil involved si Padojinog sa inspection at negotiations, dapat alam niyang secondhand ang helicopters at kasama siya sa scheme.

Hindi ito tinanggap ng Supreme Court.

Suspicion, conjecture, or mere participation in an irregular transaction is not substantial evidence of administrative liability.

ABANDONMENT MAY BE CONSIDERED A VAWC

A husband’s abandonment of his wife may have legal consequences beyond the breakdown of a marriage.

In G.R. No. 263449, November 13, 2023, # # # v. People of the Philippines, the Supreme Court held that a husband's abandonment of his wife may constitute psychological violence under Section 5(i) of Republic Act No. 9262, or the VAWC Act, when it causes mental or emotional anguish.

The Court explained that spouses are legally obliged to live together, observe mutual love, respect and fidelity, and render mutual help and support. Thus, when a husband suddenly abandons his wife, these marital obligations can no longer be fulfilled.

As the Court put it, “Sudden abandonment without any explanation would certainly cause emotional anguish.”

In this case, the husband left the conjugal home and did not return or communicate with his wife for years. The wife was left to deal not only with the emotional pain of being abandoned, but also with their financial obligations.

She testified that she experienced emotional breakdown, anxiety, sleeplessness, loss of appetite, weight loss, and other emotional distress as a result.

BUT HERE IS THE IMPORTANT PART:

Abandonment is not automatically VAWC.

Hindi ibig sabihin na kapag umalis ang isang asawa sa bahay, automatic nang may criminal liability under RA 9262.

What must be established are the elements of psychological violence, including that the act or omission of the accused caused mental or emotional anguish to the victim.

In this case, the Supreme Court found that it was the abandonment—and its resulting emotional suffering—that was sufficiently established by the evidence.

In any case po, kapag ang isang tropa ay nirereklamo ng abandonment, at may evidence na pasok ito sa nabanggit na Psychological Abuse, ito ay pwedeng iconsider as Conduct Unbecoming at pwede siyang madismiss sa serbisyo.

𝐍𝐄𝐆𝐋𝐈𝐆𝐄𝐍𝐂𝐄: 𝐀𝐍𝐎 𝐁𝐀 𝐈𝐓𝐎?

Sa isang 2020 Graduate Research na pinamagatang “𝐋𝐢𝐯𝐞𝐝 𝐄𝐱𝐩𝐞𝐫𝐢𝐞𝐧𝐜𝐞𝐬 𝐨𝐟 𝐏𝐍𝐏 𝐏𝐞𝐫𝐬𝐨𝐧𝐧𝐞𝐥 𝐰𝐢𝐭𝐡 𝐃𝐞𝐜𝐢𝐝𝐞𝐝 𝐀𝐝𝐦𝐢𝐧𝐢𝐬𝐭𝐫𝐚𝐭𝐢𝐯𝐞 𝐂𝐚𝐬𝐞𝐬” mula sa University of Baguio, ang NEGLIGENCE ay identified bilang isa sa mga 𝐜𝐨𝐦𝐦𝐨𝐧 𝐜𝐚𝐮𝐬𝐞𝐬 ng administrative complaints laban sa PNP personnel, kasama ng impulsiveness at indirect culpability o command responsibility.

𝐀𝐍𝐎 𝐀𝐍𝐆 𝐍𝐄𝐆𝐋𝐈𝐆𝐄𝐍𝐂𝐄?

Simply put, negligence is the failure to exercise the care, caution, and vigilance that the situation reasonably requires.

Sa Article 1173 ng Civil Code, negligence consists of the failure to exercise the diligence required by the nature of the obligation and by the circumstances of the person, time, and place.

The Supreme Court has similarly described negligence as the failure to observe the degree of care, precaution, and vigilance that the circumstances demand.

In simple terms: KAPABAYAAN O PAGPAPABAYA.

“Ano ang dapat ginawa ng isang reasonably careful police officer sa ganitong situation—and ginawa ba niya iyon?”

Kung ang isang ordinarily prudent police officer, under the same circumstances, would have acted more carefully, pero hindi ito ginawa ng respondent, possible na may negligence.

Ang NEGLIGENCE ay kadalsasng pasok sa Ngelect of Duty. Pero pwede din siyang maging Inrregularity, Misconduct or Conduct Unbecoming, depende sa mga circumstances.

Tandaan: Hindi kailangang sinadya ang isang act para magkaroon ng negligence.

Negligence is generally about lack of proper care, not necessarily bad intention.

Negligence = failure to exercise the care, caution, and vigilance reasonably required by the situation.

At sa PNP service, ang isang simpleng “nakalimutan ko,” “hindi ko napansin,” “hindi ko na-check,” o “hindi ko inakala na mangyayari iyon” ay maaaring maging mahalagang issue kung may duty ang officer na dapat niyang gampanan at ang failure niyang gawin ito ay nagresulta sa violation, harm, or other administrative consequence.

Sa police service, due care is part of duty.

Sa bawat kasong iyong babasahin,
May pangalan na maaaring masira.

May dangal na maaaring mawala,
At pamilyang maaaring lumuha.

Kaya pairalin ang katarungan,
Bago tuluyang humatol.

𝐈𝐌𝐏𝐔𝐋𝐒𝐈𝐕𝐄𝐍𝐄𝐒𝐒: 𝐊𝐀𝐏𝐀𝐆 𝐍𝐀𝐔𝐍𝐀𝐇𝐀𝐍 𝐍𝐆 𝐑𝐄𝐀𝐊𝐒𝐘𝐎𝐍 𝐀𝐍𝐆 𝐏𝐀𝐆-𝐈𝐈𝐒𝐈𝐏

Sa isang 2020 Graduate Research na pinamagatang “Lived Experiences of PNP Personnel with Decided Administrative Cases” mula sa University of Baguio, ang IMPULSIVENESS ay identified bilang isa sa mga common causes ng administrative complaints laban sa PNP personnel.

𝐀𝐍𝐎 𝐀𝐍𝐆 𝐈𝐌𝐏𝐔𝐋𝐒𝐈𝐕𝐄𝐍𝐄𝐒𝐒?

Impulsiveness is the tendency to act or react quickly and without sufficient thought, consideration, or control of one's emotions.

Sa simpleng salita:

“𝐊𝐮𝐦𝐢𝐥𝐨𝐬 𝐦𝐮𝐧𝐚 𝐛𝐚𝐠𝐨 𝐦𝐚𝐠-𝐢𝐬𝐢𝐩.”

Hindi lahat ng mabilis na decision ay impulsive. Sa police work, maraming situations ang nangangailangan ng quick decision-making.

Ang problema ay kapag ang mabilis na action ay ginawa 𝐰𝐢𝐭𝐡𝐨𝐮𝐭 𝐩𝐫𝐨𝐩𝐞𝐫 𝐣𝐮𝐝𝐠𝐦𝐞𝐧𝐭, 𝐫𝐞𝐬𝐭𝐫𝐚𝐢𝐧𝐭, 𝐨𝐫 𝐜𝐨𝐧𝐬𝐢𝐝𝐞𝐫𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐭𝐡𝐞 𝐜𝐨𝐧𝐬𝐞𝐪𝐮𝐞𝐧𝐜𝐞𝐬.

𝐈𝐌𝐏𝐔𝐋𝐒𝐈𝐕𝐄𝐍𝐄𝐒𝐒 𝐒𝐀 𝐏𝐎𝐋𝐈𝐂𝐄 𝐖𝐎𝐑𝐊

A police officer is expected to remain calm, disciplined, and professional, especially when dealing with stressful, provocative, or dangerous situations.

Ang impulsive behavior ng isang police officer can have serious consequences.

A moment of anger can become a disciplinary complaint.

A careless reaction can become a misconduct issue.

Halimbawa:
- Mabilis na nagalit at nakipagtalo sa isang civilian dahil sa provocative remarks.

- Gumamit ng unnecessary force dahil sa galit o frustration.

- Nagbitaw ng threatening or insulting words dahil sa emotional reaction.

- Nag-post sa social media habang galit at hindi muna inisip ang possible consequences.

- Gumawa ng decision or action without verifying the facts, resulting in a complaint or other problem.

Hindi ibig sabihin na bawal magalit ang isang police officer.

Ang expectation ay kaya niyang kontrolin ang kanyang reaction, gamitin ang kanyang judgment, at panatilihin ang professionalism kahit under pressure.

A decision made without proper judgment can affect not only the officer, but also the credibility and reputation of the PNP.
